Article 1
These Regulations are prescribed pursuant to Paragraph 3, Article 16 of General Defense
Mobilization And Preparation Act (hereinafter referred to as “The Act”).
Article 2
The term “daily necessities” under these Regulations shall mean rice (mainly brown rice), edible
oils, culinary salt, infant and follow-on formulas, liquefied petroleum gas (LPG), and other daily
necessities specified by the competent authority in charge of preparatory planning of gratuitous and
non-gratuitous rationing during daily necessity shortage periods (hereinafter referred to as
“Competent Authority”).
The term “periods” under these Regulations shall mean the Mobilization Implementation Phase set
forth in Subparagraph 2, Article 2 of the Act and the Blockade set forth in Paragraph 2, Article 11 of
Enforcement Rules for the Act.
The term “gratuitous rationing” under these Regulations shall mean rations in kind for servicemen
and personnel engaged in military activities.
The term “non-gratuitous rationing” under these Regulations shall mean rationing of daily
necessities with prices to nationals in general and specific personnel.
The term “specific personnel” referred to in the preceding paragraph shall mean foreign diplomatic
personnel, commercial representatives aliens and dependents thereof in the Republic of China.
Article 3
Operation of rationing in kind for servicemen and personnel engaged in military activities shall be
performed by Ministry of National Defense pursuant to statutory duties and powers and applicable
laws.
Article 4
Districts, items and standards of non-gratuitous rationing shall be as follows:
1. Districts: Include Taiwan, Penhu, Kinmen and Matsu
2. Items: Daily necessities mentioned in Paragraph 1 of Article 2 herein.
3. Standards set forth in Schedule 1.
4. For natural gas users, each municipal and county (city) government shall draft alternative action
plan in the event of gas supply interruption, and include such a plan in the non-gratuitous rationing
implementation plan during daily necessity shortage (hereinafter referred to as “Implementation
Plan”).
Article 5
Security stockpile for each non-gratuitous rationing item:
1. Rice: 3 month supply.
2. Edible oils
(1) Finished products: 1 month supply
(2) Material: 2 month supply
3. Culinary salt
(1) Finished products: 1 month supply
(2) Material: 2 month supply
4. Infant and follow-on formulas: 3 month supply.
5. Liquefied petroleum gas: the average sales volume and usage volume in the past twelve months
and no less than twenty-five days of supply.
The security stockpile of non-gratuitous rationing items in the preceding subparagraphs shall be
prepared and included in annual readiness plan respectively by Agriculture and Food Agency,
Ministry of Agriculture, Industrial Development Administration, Ministry of Economic Affairs,
Taiwan Food and Drug Administration, Ministry of Health and Welfare, and Energy Administration,
Ministry of Economic Affairs.
Article 6
Authority of government agencies in charge of preparing non-gratuitous rationing items:
1. Agriculture and Food Agency, Ministry of Agriculture: Responsible for supervision of all
branches and local offices to establish central supply stations by regions for the supply of rice.
2. Industrial Development Administration, Ministry of Economic Affairs: Responsible for
supervision of public and private manufacturers to establish central supply stations by regions for
the supply of edible oils and culinary salt.
3. Taiwan Food and Drug Administration, Ministry of Health and Welfare: Responsible for
supervision of importers to establish central supply stations by regions for the supply of infant and
follow-on formulas.
4. Energy Administration, Ministry of Economic Affairs: Responsible for supervision of oil
refineries and importers and liquefied petroleum gas packing business entities to establish central
supply stations by regions for the supply of liquefied petroleum gas.
Tasks of the preparatory government agencies specified in the preceding paragraph are as follows:
1. To set the security stockpile for each non-gratuitous rationing item and take inventory of total
on-hand stock.
2. To draft the operating procedure for establishing central supply stations.
3. To select the locations of and establish central supply stations.
4. To conduct drills.
Article 7
Authority of local government agencies conducting non-gratuitous rationing:
1. Municipal and county (city) governments shall, as per planning of the competent authorities, be
responsible for the following preparatory work and include such in the Implementation Plan for
preparation.
(1) To plan application, collection, transportation, distribution, receiving, storage, issuance and
safeguard of non-gratuitous rationing items.
(2) To complete Annual Estimates of Quantity and Amount of Non-gratuitous Rationing Items
(Schedule 2), Household Non-gratuitous Rationing Record Sheet (Schedule 3), Government
Invoice/Delivery Note of Non-gratuitous Rationing Items (Schedule 4) and Estimates of Recipients
(Schedule 5).
(3) To establish and manage non-gratuitous rationing stations and personnel thereof and check
reasonableness between operation capacities and staff disposition in a rolling manner.
(4) To conduct drills.
2. District, town, township and city offices shall, as per planning of respective municipal and county
(city) government, be responsible for the following preparatory work:
(1) To perform application, receiving, storage, and safeguard of non-gratuitous rationing items.
(2) To select locations of and establish non-gratuitous rationing stations and staff the personnel
thereof.
(3) To prepare a recipients’ roster (Schedule 6).
(4) To conduct drills.
Article 8
As detailed in Schedule 7, the implementation system for non-gratuitous rationing is as follows:
1. Central competent authorities of ministries, councils and commissions shall constitute Gratuitous
and Non-gratuitous Rationing Of Daily Necessities Guidance Board (hereinafter referred to as
Guidance Board) with the organization detailed in Schedule 8. Tasks to be carried out are as
follows:
(1) To supervise Non-gratuitous Rationing Of Daily Necessities Executive Committees of municipal,
county (city) governments to implement non-gratuitous rationing.
(2) To appraise, decide and announce prices of non-gratuitous rationing items.
(3) To check for hoarding and profiteering and illegal transactions of non-gratuitous rationing items.
(4) To announce reduction in supply or temporary expropriation of substitutes with compensation
pursuant to law, in the event of undersupply of non-gratuitous rationing items.
(5) To approve and announce a switch to gratuitous operation when there is a concern that
non-gratuitous rationing may not operate normally.
2. Municipal and county (city) governments shall constitute Non-gratuitous Rationing Of Daily
Necessities Executive Committees with the organization detailed in Schedule 9. Tasks to be carried
out are as follows:
(1) To supervise Non-gratuitous Rationing Of Daily Necessities Executive Task Force of district,
town, township and city offices to implement non-gratuitous rationing.
(2) To comply and check for hoarding and profiteering and illegal transactions of non-gratuitous
rationing items.
(3) To supervise and coordinate the supply of liquefied petroleum gas to the public by LPG retailers.
(4) To carry out relevant work as per announcements made by Guidance Board.
3. District, town, township and city offices shall constitute Non-gratuitous Rationing Of Daily
Necessities Executive Task Force with the organization detailed in Schedule 10. Tasks to be carried
out are as follows:
(1) To supervise the establishment of non-gratuitous rationing stations with the organization
detailed in Schedule 11 and implementation of the non-gratuitous rationing operation by urban/rural
village offices.
(2) To distribute forms and sheets for the non-gratuitous rationing operation.
Article 9
The selection of locations for non-gratuitous rationing stations shall be planned and prepared in
times of peace, comply with Article 29 of the Act and meet the following criteria:
1. Locations with heavy population and convenient transportation.
2. Loci with spacious storage and multiple exits and entrances.
3. Equipped with complete functions of fire resistance, air defense, ventilation, water and electricity
supply and parking.
4. Appropriate safety segregation and different access routes shall be in place if the selected location
is the same as a disaster victim shelter.
The number of stations to be established shall be in principle one station per urban or rural village.
Such numbers are subject to change after taking into consideration of actual situations of terrain,
population, transportation and facilities.
Article 10
Implementation of non-gratuitous rationing shall be in accordance with the following regulations:
1. Timing of implementation: To be implemented after submission to the Executive Yuan for
approval by competent authorities depending on the situation, and to dissolve is likewise.
2. Implementation of non-gratuitous rationing:
(1) Each municipal and county (city) government shall prepare on its own conveyance to collect the
non-gratuitous rationing items at the central supply stations and transship such to non-gratuitous
rationing stations for receiving, storage and distribution.
(2) Collection of the non-gratuitous rationing items reapplied for purchasing can only be made after
all outstanding payments have been settled.
(3) The supply and sale of liquefied petroleum gas shall be conducted in such ways as in times of
peace, and may be conducted via a voucher system. Liquefied petroleum gas shall never be placed
in non-gratuitous rationing stations.
(4) Each recipient shall, at the time and place as announced, go to the designated non-gratuitous
rationing station with their valid identity document and Household Non-gratuitous Rationing
Record Sheet, and purchase the items at the prescribed quantity and price. Each recipient may in
principle conduct such purchase one to three times a month.
3. Operating procedures, instructions and matters to comply with during the non-gratuitous
rationing period shall be separately prescribed by the Competent Authority.
Article 11
Government agencies and institutions concerned shall provide funds needed for preparatory work of
non-gratuitous rationing from annual budgets compiled for that purpose.
Article 12
These Regulations shall come into force as of the date of promulgation.
