Title: Guidelines Governing the Application of Foreign Students to the ROC in the Capacity of Interns in Enterprises and Organizations Ch

Content:

1. In order to facilitate applications of foreign students with education backgrounds of 
    college level or above for practical training in the Republic of China (referred to as
    Taiwan below), and furthermore to promote mutual  understanding and talent hunting,
   the following guidelines are adapted.

2. Except for cases involving disturbing public order or decency customs, endangering
    national security, public interests, and national health, or causing significant ccupational
    disaster or dangers, enterprises and organizations may apply for internship for foreign
    students with education backgrounds of college level or above, to the Ministry of
   Economic Affairs (MOEA) according to the guidelines. The Ministry consults business
   supervising authorities for approval of the application, and transfers the approval note to
   the foreign student as the proof required for applying for a visa in our embassies and
   missions abroad, that may determine whether or not to issue the visa based on its
   authority.
   The Ministry shall establish the unified window, the Investment Commission, MOEA,
   to deal with applications in accordance with the guidelines.

3. The enterprises mentioned in the guidelines include: domestic businesses, overseas
    Chinese investment business, branches or offices of foreign companies in Taiwan, and
    businesses in free port areas referred to in Paragraph 2 of Article 3, the Management
    Regulations of the Free Trade Port Areas. The organizations include the juridical
    person affiliated to the Ministry of Economic Affairs and foreign commercial chambers,
    or other organizations that are approved by the central competent authorities.

4. The internship applicants for foreign students shall be qualified with one of following   
    conditions, except in cases with special approval from the business supervising
    authorities.
(1)Domestic businesses and overseas Chinese investment businesses shall have revenue
    over NT 10 million dollars in most recent year, or capital over NT 5 million dollars as
    newly founded establishment.
(2)Branches of foreign companies shall have yearly revenue over NT 10 million dollars or
    business capital over NT 5 million dollars as a newly founded business in Taiwan.
(3)Offices of foreign companies in Taiwan shall conduct procurements of over US 1
    million dollars, except for offices of financial institutes.
(4)Businesses in free port areas designated in Paragraph 2 of Article 3, the Management  
    Regulations of the Free Trade Port Areas.
(5)The juridical person affiliated to Ministry of Economic Affair and other organizations
    approved by the central competent authorities shall have business funds over NT 5
    million dollars in the most recent year.
(6)Foreign commercial chambers.
(7)The startups that meets “the official criteria for designation as a business start-up with
     innovation capability”, or the enterprises meet the key development industries
     approved by the Executive Yuan.

5. The foreign students seeking internship shall be in schools that are listed in the
    reference book of foreign colleges and universities, issued by Ministry of Education, as
    well as approved college schools by the business supervising authorities.

6. The foreign students approved for internship shall not be allowed to change the original
    plan, or transfer to any other units except for the approved one.

7. To apply for internship for foreign students in Taiwan, the applicant shall prepare the
    following documents and present them to the Investment Commission, MOEA.
(1)The application form.
(2)The student background information form.
(3)The enterprise shall prepare the company registration, business registration or limited
     partnership registration, the return form for business revenue tax in most recent year,
     the certificate of procurement amount, and other proof(documents), while the
     enterprise or office of the newly funded financing institute shall be exempted from
     presenting the return form.
(4)The juridical person affiliated to the Ministry of Economic Affairs and other
     organizations approved by the central competent authorities shall present duplicate
     copies of the founding proof, organization memorandum, and other relevant
     certificates.
(5)The foreign commercial chambers shall issue the formal application letter.
(6)The startups shall present certificates that meet “the official criteria for designation as a
     business start-up with innovation capability”.
(7)The enterprises meet the key development industries approved by the Executive Yuan
     shall present certificates.
(8)The internship plan (describes the training contents, locations, terms, training director,
     expenditures, sponsorship, and living expense subsidy)
(9)Duplicate copy of student’s passport.
(10)The school enrollment certificate.
(11)Other documents required by the business supervising authorities.

8. The internship term shall be within 6 months; however, there is allowance, if necessary,
    for single extension following the expiration. The term for extension shall not be longer
    than the original approved one.

9. The foreign students conducting internship in Taiwan shall abide by all relevant laws or
    regulations, and shall not be allowed to work for any job different from the one
    approved.
