1. These Directions are hereby stipulated by the Bureau of Standards, Metrology and Inspection
(BSMI) for implementing the inspection of children’s bedguards for domestic use.
2. Scope of Inspection: Children’s bedguards for domestic use.
3. Inspection Scheme: Type Approved Batch Inspection or Registration of Product Certification
(Module II-Type Test + Module III-Declaration of Conformity to Type) at the choice of the
applicant.
4. Inspection Standards:
(1)CNS 15911:2017 “Child use and care articles – Children’s bedguards for domestic use”
(2)CNS 15503:2019 “General safety requirements for children's products”
5. Inspection Items:
(1) Structure: Items specified in Sections 5.1 to 5.6 of CNS 15911, including “general,”
“detachable components,” “non-detachable components,” “mesh,” “security of bedguard,” and
“folding and locking mechanisms.”
(2) Plasticizers and heavy metals: Items specified in Section 4.5.1 “phthalate plasticizers” of CNS
15503 and Section 4.1 “migration of certain elements” of CNS 15911.
(3) Chinese Labeling: The texts should primarily be in traditional Chinese. The following items are
to be checked in accordance with the Commodity Labeling Act and CNS 15911.
a. Product name;
b. Main materials;
c. Name, phone number and address of the manufacturer and the origin of the product; for
imported product, the name, phone number and address of the importer and the origin of the
product should be indicated.
d. Product dimensions (length and height).
e. The minimum and maximum length of the applicable mattress (the maximum length can be
marked up to 212 cm).
f. Applicable mattress thickness.
g. Manufacturing date (year, month)
h. Precautions (such as: unsuitable bed bottoms and assembled slats, storage methods, cleaning
methods, keeping away from fire sources, etc.).
i. Warning: This product is not suitable for use by infants and young children under 18 months of
age.
(4) Items e, f and i of the preceding paragraph shall be permanently marked on the product.
(5) The font height of "Warning" in Item i of the preceding paragraph should be at least 5 mm, and
the font height of other explanatory texts should be at least 3 mm.
(6) Commodity Inspection Mark: The Mark shall be printed by the obligatory inspection applicant
responsible for inspection application in accordance with the provisions of the “Regulations
Governing the Use of Commodity Inspection Mark” and displayed on a prominent place of the
product.
6. Relevant Requirements for Type Test:
(1) Principles of Type Determination
a. Same Type: bedguards under the same c.c.c code, of the same main frame material (such as
metal, plastic or wood) and of the same frame structure (with base or without base).
b. Main Type: Among products of the same type, the one with the most folding mechanisms shall
be regarded as the main type.
c. Series of Type: Within the same type, excluding the main type, variations based on fixing
methods (e.g., embedded, embedded + Y-straps, embedded + locking screws), railing structures
(e.g., expandable, non-expandable, whole piece, railing style, modular), and different numbers of
folding mechanisms.
(2) Locations for Performing Type Test: BSMI or BSMI designated testing laboratories.
(3) Type Test Items: Each main type product undergoes tests as per Sections 5.1 to 5.6 of CNS
15911; each series type product undergoes testing as per CNS 15911 Sections 5.5, 5.6.1, and 5.6.2.
Different colors and patterns are regarded as the same type and do not require separate testing.
(4) The obligatory inspection applicant applying for type test shall submit three copies of the
following documents as well as product samples to the type testing locations for performing the
test:
a. Type classification table.
b. Color photos of the children’s bedguards for domestic use (4x6 inch or larger-sized photos
showing the front, rear and side views of the product).
c. Samples of the Chinese labels.
d. User's manual.
e. Product Information Description, including product structure diagrams, a list of components,
and materials.
f. Samples: Two pieces each of the main type and each series type of children's bedguard samples
must be submitted. The acceptance unit may request additional test samples if necessary. The
testing laboratories may request additional test samples if necessary.
g. Declaration of Validated Materials of the Children’s Bedguards for Domestic Use.
(5) Type Test Fees: The fees shall be collected in accordance with the Regulations Governing Fees
for Commodity Inspection or the fee schedule specified by the designated testing laboratories.
7. Relevant Requirements for Type Approved Batch Inspection:
(1) The obligatory inspection applicant shall first obtain the type approval certificate and make
applications to the inspection authority for inspection before their products are transported out of
the production premises or imported. When applying for inspection, the month and year of
manufacture shall be filled in, and the Commodity Inspection Mark shall be printed on the
applicant’s own responsibility. The Commodity Inspection Mark consists of a diagram and an
identification number (including the letter “T” and a designated code). The identification number
shall be proximately below or to the right of the diagram. The products shall not be transported out
of the production premises until they pass inspection.
(2) The obligatory inspection applicant applying for type approval shall submit to the inspection
authority the type test report, the required documents specified in Clause 6.(4),
the application
checklist for type test report signed by the type testing laboratory, copies of company, business
or factory registration documents or other equivalent registration documents.
(3) The Review Period of Type Approval: 14 working days from the receipt of the application by
the inspection authority (not including the time for delivery of additional information by the
applicant).
(4) The children's bedguards for domestic use submitted for inspection in the same batch must be
from the same obligatory inspection applicant and of the same type.
(5) The inspection authority shall confirm that the Children’s bedguards for domestic use
submitted for inspection are listed in the Type Approval Certificate. 20% of the applications will be
randomly sampled for inspection and the other 80% are processed by document review. For the
20% sampled applications, one-third of the items listed in the same application shall be randomly
selected for drawing samples (the number of items less than three shall be counted as three; a
minimum of one item and a maximum of five items shall be selected). For each selected item, one
piece of the products under that item shall be randomly sampled for testing and checked for the
Chinese labeling and the Commodity Inspection Mark. The quantity of selected items and sampled
pieces may be increased if necessary.
(6) Those which are sampled for further inspection are subject to tests specified in Section 5.5
“Security of bedguard” of CNS 15911. The quantity of selected items and sampled pieces may be
increased if necessary (e.g. “folding mechanism,” “phthalate plasticizers,” “migration of certain
elements”).
(7) Inspection Period: 7 working days upon receipt of samples.
(8) Where the products are approved for prior release by the inspection authority, the obligatory
inspection applicant shall notify the inspection authority to take samples, seal the products or
check the Commodity Inspection Mark and Chinese label after the products are transported to the
storage site. The inspection authority shall sample the products in accordance with Article 12 of
tthe Enforcement Rules of the Commodity Inspection Act.
(9) The inspection authority shall issue a notice of nonconformity for products that do not comply
with the requirements. The obligatory inspection applicant may apply for re-inspection without any
charge for one time within 15 days after receiving such notice. Products that comply with the
requirements may be released separately. Products that do not comply with the requirements shall
be processed in accordance with the Regulations Governing Disposition of Commodities Failing
Inspection as specified below.
a. An applicant may apply to the inspection authority for a new inspection under the condition
that an improvement plan is submitted for approval within 30 days from the day following the
date of receiving a notice of noncompliance. However, if a year has passed since the day following
the receipt of the initial notice of non-compliance, the applicant may no longer submit an
improvement plan for approval.
b. Where the non-compliant products are to be returned, the obligatory inspection applicant shall
submit the re-export customs declaration issued by the Customs Administration, Ministry of Finance,
along with other relevant documents to the original inspection agency for case closure within three
months after the goods have been re-exported. The original inspection agency will close the case
after verifying that the online re-export data provided by the applicant matches the records of the
Customs Administration, Ministry of Finance.
c. Where the non-compliant products are to be destroyed, the obligatory inspection applicant shall
submit the notice of non-compliance, the import declaration (not required for domestic manufacturers),
and the destruction plan directly to the original inspection agency for approval. The inspection agency
shall assign personnel to supervise the destruction.
d. After improvements are made to the non-compliant items and they are submitted for
re-inspection together with other unselected items, the obligatory inspection applicant
shall attach the notice of non-compliance, the import declaration (not required for domestic
manufacturers), and a verified improvement plan, along with the application form to the BSMI.
After obtaining approval from the BSMI, the obligatory inspection applicant shall prepare the
re-inspection approval letter, the supervision record of the improvement for non-compliant goods,
the notice of non-compliance, and the import declaration (not required for domestic manufacturers)
and proceed with the re-inspection application at the original inspection agency.
e.
If the non-compliant items are destroyed or returned, and the obligatory inspection applicant
wishes to apply for re-inspection of other unselected items, the applicant must submit the notice
of non-compliance and the import declaration (not required for domestic manufacturers), along
ith the application form to the BSMI for approval. Upon receiving approval from the BSMI, the
obligatory inspection applicant shall prepare the re-inspection approval letter, the notice of
non-compliance, the import declaration (not required for domestic manufacturers), and the
destruction record of the non-compliant items (or the re-export customs declaration as a substitute)
and proceed with the re-inspection application at the original inspection agency.
f. Where a re-inspection application is made for non-compliant products, the sampling rate of items
specified in Paragraph (6) shall apply. The non-compliant products of which correction is made under
surveillance are required to be sampled under a re-inspection application. The batches not sampled
shall be released after document review and compliant batches may be released separately.
(10) Where the products sampled are found not in compliance with the inspection requirements,
subsequent children’s bedguards for domestic use from the same obligatory inspection applicant
shall be inspected by batch. The sampling rate will be resumed to 20% after compliance of 3
consecutive batches.
(11) If there are changes to the scope of the products listed in the type approval certificate (e.g.
changes to the main type or series of type, inspection standards or inspection items), the applicant
shall obtain a new type test report from the testing laboratory that issued the original report and
apply for a replacement certificate to the inspection authority.
8. Relevant Requirements for Registration of Product Certification (RPC):
(1) To apply for an RPC certificate, the applicant shall submit copies of the company, business
or factory registration documents or other equivalent registration documents, conformity
assessment documents (type test report and declaration of conformity to type), the application
checklist for type test report signed by the type testing laboratory, and the required documents
specified in Clause 6(4).
(2) The Review Period of RPC: 14 working days from the receipt of the application by the
inspection authority (not including the time for delivery of additional information by the applicant).
Where additional samples are drawn, such period shall be extended to another 14 working days
after the receipt of the samples.
(3) Applicants granted RPC certificates shall print the Commodity Inspection Mark on their own
responsibility. The Commodity Inspection Mark consists of a diagram and an identification
number (a letter “R” and a designated code). The identification number shall be proximately below
or to the right of the diagram.
(4) If there are changes to the scope of the products listed in the RPC certificate (e.g. changes to
main type or series of type, inspection standards or inspection items), the applicant shall obtain
a new type test report from the testing laboratory that issued the original report and apply for
a replacement certificate to the inspection authority.
