1. These Directions are instituted as to handle affairs relating to the inspection of toy commodities.
2. The inspection authority mentioned in these Directions shall mean the Bureau of Standards,
Metrology and Inspection (the BMSI) of the Ministry of Economic Affairs and its branches.
3. Toy commodities evaluated in accordance with Regulations Governing of the Criteria for
Identification of Risks of Hazard, are divided into toy commodities with low risk of hazard and
medium risk of hazard (see Appendix 1). The following inspection schemes adopt in accordance
with risk of hazard:
(1)Toy commodities with low risk of hazard: Declaration of conformity.
(2)Toy commodities with medium risk of hazard: Monitoring inspection or the registration of
product certification [type test (Mode2) + declaration of conformity to type (Mode3)].
Toy commodities with low risk of hazard and medium risk of hazard at the same time, the
inspection schemes adopt to toy commodities with medium risk of hazard.
4. The inspection scheme of monitoring inspection:
(1)Location receiving the inspection:
a. Commodities produced domestically: the inspection shall be applied in accordance with the
production place to the inspection authority in the jurisdictional region; the inspection may be
applied to the inspection authority in other jurisdictional regions if necessary.
b.Commodities imported via agency or importer: the inspection shall be applied in accordance with
the ports where the commodities arrive to the inspection authority in the jurisdictional region; the
inspection may be applied to the inspection authority in other jurisdictional regions if necessary.
(2)Inspection location: the inspection authority commissioned by the BMSI.
(3)Inspection time limit: within 7 workdays from the day when the sample of commodities subject
to inspection arrives at the inspection authority.
(4)Inspection charge: 0.25% of the shipping wholesale prices for commodities produced
domestically (untaxed) or the CIF for commodities imported. Where the minimal charge per batch is
assessed less than NT$500 will be charged at NT$500 whereas the charge of the part exceeding
NT$100,000 will be reduced to half thereof.
(5)The commodity inspection mark is comprised of a set of pattern and ID No. where the ID No.
shall be closely next to the right side or the underneath of the basic pattern.
The pattern of the commodity inspection mark is .
The ID number of the commodity inspection mark shall be comprised of a set of an alphabet, serial
numbers or specified codes pursuant to the diversity of inspection schemes.
a. For the inspection obligatory applicant who applies for the self-printed commodity inspection
mark, the inspection obligatory applicant shall apply to the local inspection authority with
jurisdiction for the application of self-printed alphabet M and the specified codes.
b. When the inspection obligatory applicant applies for toy commodities, the self-printed
commodity inspection mark M00000 and batch No. [no repeated usage is allowed] shall be filled
out in details on the commodity inspection mark column and batch No. column of the inspection
application form. Moreover, M00000 and batch No. (7-number) shall be separated in upper and
lower lines together labeled on the body of the commodity concerned or the minimal package
thereof and close to the right side or the underneath of the basic pattern as to implement the
post-market management mechanism and commodity tracing function.

first and second numbers are the rear 2 numbers of the western year of the imported or produced
date in principle; the third and fourth numbers are the month of the imported or produced date; the
fifth to seventh numbers are serial numbers]

(6)Inspection scheme:
a. The inspection obligatory applicant shall apply for toy commodities inspection in accordance with
Regulations Governing Monitoring Inspection and submit the photo or pre-printed specimen page of
Chinese label for batches that are sampled, as well as register all of the names of the toy
commodities in the name of commodities of the application form for BMSI inspection computer
system of the with e-file as applying for the inspection of toy commodities imported or produced
domestically; the name of commodities may be attached the appendix. The application shall be
denied if the application is not handled in accordance with the previous regulations. It requires the
inspection obligatory applicant to submit the re-application for inspection with the supplemented or
corrected data.
b. Where the toy commodities applies by the same inspection obligatory applicant for inspection
conform to the provisions via batch-by-batch inspection for the consecutive 10 batches, the
inspection will be exercised via the random-selected batch inspection as known as 50% per batch;
afterwards, where the commodities conform to the provisions for the consecutive 10 batches, the
inspection will be exercised via random-selected batch inspection as known as 20 % per batch.
c. Where any inconformity occurs in the sampled batch, the toy commodities applied by the same
inspection obligatory applicant for inspection must require the conformity to the provisions for the
consecutive 10 batches; afterwards, the inspection will be exercised via the random-selected batch
inspection as known as 50% per batch will be exercised on the follow-up batches.
d. The sampling proportion of the sampled batch is one out of five for those within 100 items in
principle, but each sampled batch shall be sampled one item at least and five items at most; for those
exceeding 100 items, every 20 items of the exceeding part add 1 sampling inspection item of which
2 pieces (sets) are sampled. However, such a sampling proportion may be adjusted flexibly in
accordance with the actual requirements.
e. The inspection and the check of commodity inspection mark and Chinese label must be exercised
on the sampled item(s). Where the whole batch of toy commodities has obtained the type test report
issued by the designated testing laboratory for toy commodities (hereinafter referred to as the
“designated testing laboratory ”) recognized by the BMSI (confined to the identical type test report
within 12 months prior to the application for inspection), it requires to perform the onsite check of
the items such as packages, exterior appearance, commodity inspection mark and Chinese label.
f. Batches of toy commodities are not sampled under random-selected batch inspection and shall
execute the check of computer database to confirm the conformity of the commodities subject to
inspection to the qualification of releasing after document examination. The list of toy commodities
verification is sampled by computer system, as well as in accordance with the ways prescribed as
below:
(a)The random-selected batch verification on exterior appearance, commodity inspection mark and
Chinese label by batches as known as 50% per batch is exercised; the sampling inspection may be
exercised if necessary.
(b)The procedure of release after document examination shall apply to batches of commodities that
are not sampled under random-selected batch verification.
g.Where the toy commodities are approved for the prior release by the inspection authority
receiving the application for inspection, the inspection obligatory applicant shall notify the
inspection authority to execute the check of commodity inspection mark and Chinese label,
sampling and sealing at the location where the commodities are stored after the relevant procedures
are accomplished.
h.For toy commodities that could happen the inspection inconformity, the inspection obligatory
applicant shall make a new application for inspection, return the commodities, or destroy the
commodities, in accordance with the following rules:
(a)For whole batch of toy commodities that do not comply with inspection requirements and are to
be returned the commodities, the inspection obligatory applicant shall apply to custom or the local
inspection authority to be close the case.
(b)For whole batch of toy commodities that do not comply with inspection requirements and are to
be destroyed, the inspection obligatory applicant shall submit the destroyed plan to the local
inspection authority to be close the case.
(c)If toy commodities that could happen the inspection inconformity or part of toy commodities
need to be returned, or destroyed, the inspection obligatory applicant shall submit approval letter
issued by the BSMI, unsatisfactory inspection notice by the BSMI, Import Declaration (If
necessary), and verification document for the modified, adjusted, or reprocessed accessories to the
local inspection authority for a new inspection application.
(d)The sampling rate of a new inspection application due to toy commodities that the inspection
inconformity is exercised pursuant to the provisions prescribed in item (4). Nevertheless, for toy
commodities that could happen the inspection inconformity commodities via improvement as
necessary sampling items, the double sampling rates shall be exercised.
(e)For a new inspection application due to toy commodities that failed the inspection, partial
accessories of toy commodity via destroyed and approved by the BSMI that may not be sampled.
i. Where toy commodities purchased or sampled are inspected to be inconformity with the
inspection standards orincomplete inspection procedure before entering market, the same inspection
obligatory applicant applies for toy commodities that conform to the provisions via batch-by-batch
inspection for the consecutive 10 batches; afterwards, the provisions prescribed in Subparagraph 6
item (2) will be exercised on the follow-up batches and also in accordance with The Commodity
Inspection Act.
5. The inspection scheme of the registration of product certification:
(1)The procedures to apply for type test report: Each 3 samples of the main type and serial types at
least shall be submitted to the designated testing laboratory for the type test application.
(2)The applicant applying for the registration of product certification shall apply for the issuance of
the certificate of the registration of product certification to the inspection authority via submitting
the papers listed below:
a. Basic documents: The documents in accordance with Regulations Governing Registration of
Product Certification Article 2, Subparagraph 2 Item 1.
b. Documents of conformity assessment: The documents in accordance with Regulations Governing
Registration of Product Certification Article 2, Subparagraph 2 Item 2-2 A and B.
c. Technical documents:
(a)Table of the registration of product certification type classification (Appendix 2) signed by
designated testing laboratory;
(b)Table of statements from the agent of the obligatory applicant (Appendix 3);
(c)Table of descriptions of toy commodities (Appendix 4);
(d)Check table of materials of commodities / parts and main raw materials (Appendix 5);
(e)Specimen page of Chinese label;
(f)Table of statements of the current quality assurance system [replaceable with the copy of the
Quality Management System, QMS, registration of product certification certificate approved by the
BMSI or the inspection authority recognized by the BMSI under CNS 12681 (ISO 9001)]; and
(g)Colorful pictures of toy commodities (including the actual size of toy commodities: 4 inches * 6
inches).
(3)Charge of type test: in compliance with the provisions relating to charges of the designated
testing laboratory receiving the case.
(4)Time limit of examination: 14 workdays (excluding the time of waiting for the supplemented
data) and plus another 7 workdays for the test by random sampling.
(5)Annual fee for registration, Examination fee and Authorization of certificate fee: Fee in
accordance with Regulations Governing Fees for Commodity Inspection.
(6)Expiration of the certificate of the registration of product certification: 3 years. The certificate
may be applied for the extension another 3 year for once only.
(7)Commodity inspection mark: alphabet R and specified codes (specified by the BMSI as issuing
the certificate). The inspection obligatory applicant may exercise the self-printed R00000 pursuant
to the provisions and shall label it at the right side or the underneath of the basic pattern under the
provisions of batch label prescribed in Article 4, Subparagraph 5, Item (2) of the preceding Article
and attach it to the body of commodity concerned or the minimal package thereof.

(8)Principles of classification of type and series of type:
a. The toy commodities with the identical main process, identical main texture, raw material / parts
and the identical type of basic design may identify the most complex type as the main type and
other as the series of type.
b. The toy commodities with the identical main process and identical group of raw materials and the
similar exterior appearance are deemed as the identical type with no series of type; those with
diverse exterior appearances are deemed as the series of type.
(9)Any alteration of the commodities registered on the registration of product certification
certificate shall be handled in accordance with the following provisions:
a. Where the series of type are added (without altering the main type), the approved registration of
product certification type classification table, colorful pictures of toy commodities (including the
actual size of toy commodities: 4 inches * 6 inches), check table of materials of commodities / parts
and main raw materials, Specimen page of Chinese label, and type test report shall be submitted to
the inspection authority for the application of the re-issuance of the certificate.
b. Where any main type or serial type is altered, the approved registration of product certification
type classification table, colorful pictures of toy commodities (including the actual size of toy
commodities: 4 inches * 6 inches), textures, check table of materials of commodities / parts and
main raw materials, Specimen page of Chinese label, and type test report shall be submitted to the
inspection authority for the application of the approval.
6. The inspection scheme of declaration of conformity:
(1)Type classification of low risk of hazard commodities listed in Appendix 1, Classified by
commodities’ material is as bellow:
a. Paper.
b. Plastic.
c. Other composite materials: Commodity contains more than 2 materials.
(2)The procedures to apply for type test report and test principles:
a. The procedures to apply for type test report: the inspection obligatory applicant submit the Table
of Declaration of Conformity Type Classification (Appendix 7) to the designated testing laboratory
for the application of type test report.
b. Test principles:
(a)Numbers of samples: The inspection obligatory applicant shall submit at least 3 samples.
(b)The testing items for the type test: The designated testing laboratory conduct the testing items for
the type classification of commodities in accordance with Appendix 8.
(c)Choose of samples: The designated testing laboratory samples one of the most complexity
samples for each type classification of commodities from the List of Declaration of Conformity
Type Classification. If the items of type classification of commodities are accumulated less than or
equal to 100, every 20 items to be selected one sample to conduct testing; If the items of type
classification of commodities are accumulated more than one hundred, every 50 items to be selected
one sample to conduct testing.
(3)The inspection obligatory applicant shall keep the declaration of conformity and relevant
technical documents in accordance with the Commodity Inspection Act Article 46:
a. Declaration of conformity (Appendix 9).
b. Technical documents:
(a)Type test report issued by designated testing laboratory.
(b)Table of Declaration of Conformity Type Classification signed by designated testing laboratory
(Appendix 7).
(4)Under any of the following circumstances of the signed the declaration of conformity and
relevant technical documents of type test report and Appendix 7, the inspection obligatory applicant
shall submit the original and modified Appendix 7, as well as original and modified type test report
or samples to designated testing laboratory for the application. The test principles are as below:
a. For increasing the model or items in the List of Declaration of Conformity Type Classification
Declaration:
(a)The accumulation items of type classification of commodities are over or equal to Article 6,
Subparagraph 2, Item (2) of c. requirements that shall be conducted in accordance with
Subparagraph 2 item 2.
(b)The accumulation items of type classification of commodities are not over Article 6,
Subparagraph 2, Item (2) of c. requirements that shall be modified Appendix 7.
b. For modifying testing items for the type test, the designated testing laboratory conducts testing
for modifying testing items.
(5)Commodity inspection mark: The inspection obligatory applicant shall apply to the inspection
authority for commodity inspection mark, D and specified codes (specified by the BMSI as issuing
the notice); The commodity inspection mark D00000 self-printed by the inspection obligatory
applicant, and shall be labeled on the body of the commodity concerned or the minimal package
thereof and close to the right side or the underneath of the basic pattern.

(6)Registration fee: Fee in accordance with Regulations Governing Fees for Commodity Inspection.
